1. Contractual party

These General Terms and Conditions exclusively apply to all business relations between a customer (hereinafter referred to as the "Customer") and GB International UG.

2. Content of online offer

The content of our website may contain inaccuracies or errors. The GB International UG reserves the right to make changes, corrections and/or improvements to such content any time without prior notice but does not assume any responsibility to do so. The GB International UG assumes no liability for any damage or virus which could affect your computer equipment or other property by reason of your access to, use or downloading of any material from its websites or for any illegal intrusion or intervention in the IT systems.

3. Links to third-party sites

This website may contain hyperlinks to websites unrelated to GB International UG or its affiliates. Such hyperlinks are provided for your reference and convenience only and are not operated or controlled by GB International UG, therefore GB International UG should not be taken as endorsing the operator or the content of such third-party website. You may use such links only at your own risk, and you are solely responsible for all consequences of such use. We encourage you to review and understand their privacy practices before providing them with personal information.

4. Copyright and intellectual property

The content of our website and namely but not exclusively the texts, marks, logos, diagrams, photographs, videos, sounds, music, layout, designs, know-how, technologies, products, and processes are the property of GB International UG or its affiliated companies or are used with the authorization of the owners, and accordingly are protected by copyright, trademarks, patents and all other intellectual or industrial property rights which exist under applicable law.

5. Terms of scope

The following terms and conditions apply to the purchase of all products, which are offered in all GB International UG operated online shops.

6. Acceptance of your order

6.1. The depiction and description of our items is not an binding selling offer, but a non-binding online catalogue. The placing of your order is binding by clicking on "send order" in your shopping basket. Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. Unless you cancel your order, acceptance of your order and completion of the contract between you and GB International UG will have taken place when we email you to confirm the goods have been dispatched.

6.2. In case our order confirmation contains any literal or typing errors, we are entitled to dispute, where proof of the mistake is demanded. Refunds will be issued immediately in case any payments have already taken place.

7. Delivery

7.1. Unless otherwise agreed the shipping will be carried out to the address given by the customer. Periods of delivery are nonbinding, unless otherwise expressed.

7.2. We currently ship to all countries named under section 8.2. We use UPS for delivery, and therefore are unable to deliver to APO/FPO addresses, as well as P.O. Boxes. We do not offer Saturday delivery. PLEASE NOTE: Some countries may have restrictions on the receipt of specific items. We are unable to deliver to P.O. boxes.

7.3. In case not all of the ordered items are in stock, your order will be partially delivered on our own cost, as long as it is in reasonable fashion.

7.4. If you do not receive your order after three delivery attempts, GB International UG reserves the right to withdraw from the contract and already made payments will be refunded.

7.5. In the case, that a ordered item is not in stock due to a failure of our suppliers and distributors, GB International UG reserves the right to withdraw from the contract. If this case should occur, we will inform you immediately and suggest other similar items to you. If similar items are also not available or if you do not wish to receive any suggestions, already made payments will be refunded.

7.6. Principality of Lichtenstein, Switzerland

For organizational reasons deliveries to Switzerland are only possible from a minimum order value of more than 200,-- Sfr.. The actual delivery time to Switzerland averages around 2-4 business days. Please note that we bear all the costs for the door-to-door delivery, for the transport insurance as well as for all accompanying papers, customs and import sales taxes. Please note, that foreign bank charges must be paid by the customer. For deliveries to Switzerland all indicated prices are net prices.

7.7. Shipments to non EU-countries

Your order may be subject to import duties and taxes, which are levied once a shipment reaches your country. You will be responsible for paying additional charges for customs clearance; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; please contact your local customs office for further information. Additionally, when ordering from GB International UG, you are the importer and must comply with all laws and regulations of the destination country. You authorize us to designate a carrier to act as your agent with the relevant customs and tax authorities in the destination country, to clear your merchandise and advance (on your behalf) any duties and taxes owed by you.

7.8. All shipments will be carried out through UPS. The terms and conditions of UPS will apply additionally and can be called under www.ups.com.

8. Shipping costs

8.1. The amount of shipping costs is shown in the shopping basket as you place your order in our online shop.

8.3. If the customer has special requests concerning the type of shipment, e.g. express shipment, the additional costs shall be charged. The risk shall be transferred to the customer when the goods are transferred to a forwarder or carrier, in any case when they leave of the warehouse of GB International UG.

9. Terms of payment

9.1. All prices tagged to our products on the product pages are inclusive VAT (Germany), excluding shipping costs as in section 8.2. and are calculated in EURO.

9.2. Payment is due with the placement of your order. Payments including shipping fees are accepted via credit card or bank transfer in advance.

9.2.1. Bank Transfer

By choosing the payment option bank transfer in advance the customer agrees to pay immediately after the purchase order. Affirmation of the contract and delivery will be effected upon receipt of payment. GB International UG is entitled to cancel an order, if the payment is not made within 5 working days since order.

9.2.2. Credit Card

All credit card information (numbers, expiry dates etc) will be handled with an encrypted protocol automatically to ensure that neither GB International UG nor third party have access to this information. This credit card information will only be used again after purchase transaction in the case of eventual refunds. Please note that this is a direct withdrawal.

9.3. In the event that ordered goods are not available at present, any amounts credited in advance will be refunded immediately, credit cards will not be charged in this case.

10. Liability

10.1. The warranty for defects is based on governmental terms and regulations.

Any assignment of a claim is excluded.

10.2. Liability in the case of material defects or defects of title shall follow the statutory provisions in force in the Federal Republic of Germany. Compensation for consequential damage caused by defects in delivered goods shall be excluded.

10.3. GB International UG shall not be liable for other than by injury of lives, bodies and health developing damages, unless caused by GB International UG or its employees, representatives or supporters with gross negligence or intent or based on culpable injury of a primary contractual obligation by GB International UG or its employees, representatives or supporters

10.4. Any further liabilities shall be ruled out, except of such under the German Product Liability Act or liability for an expressively warranted condition or defects, which have been suppressed maliciously.

11. Retention of title

All goods will remain in our property until payment is received in full. In the case of a delay of payment over a period of more than 10 working days, GB International UG is entitled to terminate the contract and claim back the goods.

Corresponding rights are transferable.

12. Compensation and retention

A right for compensation is only given, when your claim has been lawfully approved. Furthermore, a right for retention is only given, when your claim is based on the same contractual relationship.

13. Return and exchanges

13.1. Right to return: If you are based in the EU under the Consumer Protection (Distance Selling) Regulations 2000 (DSRs), you have the right to cancel your order with us within two weeks of delivery without making any statements or comments. Items that have been cancelled must be returned unused and in their original condition. The time limit for this begins with the receipt of these instructions AND with the receipt of your order AND with our performance of duty to inform according to article 246 § 2 in accordance with § 1 clause 1 and 2 EGBGB as well as our duties according to § 312e clause 1, 1 BGB in accordance with 246 § 3 EGBGB. As an alternative to using your rights as above, you may prefer to return or exchange items using our free returns and exchanges collection service (only bulky items). You must request your Returns Merchandise Authorization (RMA) number within 7 days of order receipt, and return your unwanted items within 14 days of order receipt, for a refund of the value of the item only, or an exchange for the same item in a different size (based on stock availability). In any case, we carry the full costs and risks of the return shipping. The items must be returned to the dispatching address.

13.2. Return and exchange follow-up: For orders cancelled under rules above, we will issue you with a full refund. However, you will need to return the entire order to us by secure means to ensure it reaches us in good condition. You are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them at our warehouse. In case of dispute, we also recommend you retain proof of sending. Refunds will be issued within 30 days of us receiving your cancellation notice. If we do not receive the cancelled order back, we will arrange to have it collected from you at your cost. The time limit here for begins with the sending of the items or your wish to use the exchanges collection service.

14. Privacy policy

We are very happy about your interest in our site. The safety of your privacy is therefore very important to us. In the following, we will inform you of our use with your data.

14.1. Data collection, process and use of personal data

The GB International UG collects and processes data only for specific and limited purposes e.g collect name of your internet service provider. Your data can also be used to evaluate the effectiveness of and improve our services to our visitors and customers. Personal data is only collected when you wish to register with the GB International UG so we can bill you for products or services you request, to verify your credit and to send out news releases. The GB International UG shall never sell, rent, share or otherwise distribute or make available your data to third parties outside of the GB International UG.

14.2. Cookie technology

Most of the information we collect from our websites is anonymous information. When you visit our website, we do not collect any personal data from you unless specifically, voluntarily and knowingly provided by you. Anonymous information is processed by the GB International UG to help improve the content our website, to customize and to learn more about our customers. In doing so the GB International UG may use tracking technology (cookies) to gather anonymous information, such as browser type, operating systems and the date and time of access. "Cookies" by themselves cannot be used to discover the identity of the user. A "cookie" is a small piece of information, which is sent to your browser and stored on your computer hard drive.

14.3. Transfer of personal data

Your data may occasionally be transferred to third parties, who act for or on behalf of GB International UG, for further processing in accordance with the purposes for which your data were originally collected, e.g. for shipment of your order or for legal or regulatory purposes.

14.4. Right of disclosure

According to German law of data protection you have the right of disclosure free of charge of your collected data and furthermore a right of correction, blocking or deleting of these data.

14.5. Contact person for data protection

You have the right to contact us to find out what personal data is held about you. If it is incorrect, incomplete or irrelevant you can request that the data is corrected or deleted. You can withdraw your consent to us using your personal data for marketing purposes (e.g. sending catalogues, newsletters or offers) whenever you like. 14.6. Security

GB International UG works with the security software SSL (Secure Socket Layer), which is based on asymmetrical encryption to prevent malpractice or deception or copying of credit card information during the purchase process.

Although we have tried to create a secure, reliable and trustworthy website for our visitors, please be aware that the internet is generally not regarded as a complete secure environment, and that therefore the confidentiality of the Data provided by you or material transmitted via this website or by e-Mail cannot be guaranteed by GB International UG. Thus, we cannot be responsible or liable for the security of your Data whilst in transit via the internet with us.

15. Other provisions

15.1. The law of the Federal Republic of Germany shall apply, the United Nations Convention on Contracts for the International Sales of Goods (CISG) expressly included.

15.2. Frankfurt (Germany) shall be the place of jurisdiction if the customer is a merchant entered in the commercial register as a merchant, a legal entity under public law, or a federal special fund under public law (§ 38 German Civil Litigation Act).

15.3. Eventual ineffectiveness of single provisions does not touch the effectiveness of the remaining provisions.
